Terms and Conditions of Sale

Payment and Delivery

Full payment is required in advance for all purchases unless otherwise agreed. We reserve the right to decline acceptance of an order if we deem there is a good reason for doing so. If we export an order to you at an address outside the UK, the total order charge made does not include any international customs and/or brokerage fees you may incur, or any applicable local sales taxes imposed by your own country of residence. Value-Added Tax (VAT) will be added to orders automatically if applicable and this amount will be calculated and shown before you commit to the order. Ownership of goods remains with Quiet PC Ltd until paid for in full.

For trade credit account customers, credit terms are that payment is due 30 days from the date of the invoice and payment needs to be received promptly in accordance with these terms, otherwise the account may be put on hold pending payment in full of the outstanding amount. Any stock discrepancies must be notified to Quiet PC Ltd within seven days of receipt of goods.

Individual product prices do not include delivery and a delivery charge will be automatically added to each order placed. This charge will be shown on the checkout page before you confirm your order. We use a variety of different carriers in order to fulfil orders, and an opportunity to select a preferred carrier method is given at checkout, but we reserve the right to use other methods and/or carriers without notice. The final decision on carrier choice is made by us depending on product weight and intended destination.

For orders received on a working day before our order cut-off time and which include only items which are in stock, we will endeavour to make a same-day despatch or as soon as possible afterwards. Deliveries sent to UK addresses will normally take one working day to arrive after despatch although extremely remote locations may take longer.

We will endeavour to show the stock status of all products on the ordering page. If you order any product(s) which are not in stock, then your order will be placed on hold until all the products you have ordered are available, and then your order will be shipped complete. If you would prefer to receive items which are in stock first, without the whole order being held up, then please place separate orders for products which are in stock and products which are out of stock. Please note that for technical reasons, your credit card will be charged within 1-2 days of placing the order on the website, not when the product is despatched. If you are unhappy with this arrangement, please wait until items are shown as being in stock before placing an order.

Occasionally it is necessary for us to request further information from you in order to perform CNP (cardholder not present) checks on payments received in order to reduce the risk of fraudulent orders. This policy is in the interests of card holders, ourselves and our bank. If you are unable to provide further information upon request then the order may be cancelled or the delivery address amended to match the registered cardholder’s address at our discretion.

Money Back Guarantee / Returns

In the unlikely event that a product from Quiet PC Ltd does not meet with your expectations, you may return the item to us. You must ensure that any returned goods are complete including all fittings and are undamaged, resalable and in their original packaging. Responsibility for shipping costs when returning goods lies entirely with you, the customer. Before returning goods, you must notify us of your intention to do so by contacting us. At that time we will provide you with a return materials authorisation (RMA) number which you need to quote on the outside of the returned package along with your name and address on a covering letter inside the returned package. Goods returned without an RMA number will not be accepted. If we do not receive your goods within 14 days of the RMA number being issued to you then the RMA number becomes void and you will need to request a new RMA number.

If you notify us that you wish to send goods back to us within 14 days of your receipt of them then we will refund both the product cost and the original shipping cost within 14 days if you are returning the complete order only. Postage will not be refunded for a partial return. The 14 day cancellation period starts on the day you receive your goods. If you notify us that you wish to send goods back to us between 14 and 30 days of your receipt of them, then upon our receipt of the returned goods we will refund the original product cost excluding the original shipping cost within 14 days of our receipt. The 30 day “money back guarantee” period starts on day you receive your goods.

We cannot accept returns of software which has been opened or activated. All goods must be returned as supplied with regard to packaging and general condition. In the event that goods are returned in unacceptable condition, refunds will made at our discretion and any refund made will be subject to a restocking fee. All special order items and items sold to trade customers are subject to a restocking fee. Please ensure your parcel is sensibly and suitably packed and protected.

Configurable PC systems and motherboard bundles are excluded from the above returns terms and conditions because such goods are built on a bespoke basis to customers’ specifications and therefore cannot easily be resold. This scenario is covered by section H6 of The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Any order containing a configurable PC system where the PC build has been started or the PC shipped and for which a cancellation/returns request is received will be at our discretion and if accepted, will be subject to a 15% cancellation charge. Your statutory rights are not affected.

Complaints

All complaints will be acknowledged within five working days and usually sooner. Please submit complaints by email or in writing. We are committed to resolving any issues as quickly as possible.

Standard Warranty

For retail purchases direct from our website, Quiet PC Ltd warrants that the products it sells are free from defects in material and workmanship for a period of two years from the date of original purchase. For goods sold to trade customers, the warranty period is the manufacturer’s warranty period only. Quiet PC Ltd will, at its discretion, either repair or replace any product which proves defective by reason of improper workmanship or materials. Repair parts or replacement products will be provided by Quiet PC Ltd on an exchange basis, and will be either new or refurbished to be functionally equivalent to new. This warranty is non-transferable.

New goods supplied to replace previously purchased goods which have failed during their warranty period will not serve to extend the warranty period which started when the failed goods were originally purchased. This warranty does not cover any damage to products which results from accident, abuse, misuse, incorrect installation, incompatibility, natural or personal disaster, or any unauthorised disassembly, repair or modification. Note that all items sold as B-Grade have a one year warranty period only which is provided by Quiet PC Ltd, and no manufacturer warranty applies.

Please note that PC problems which arise as a result of customer-installed operating system upgrades are not covered under our warranty. We may offer to undertake to fix such problems on a best-efforts basis at our standard workshop rate, which may include re-installation of the originally-supplied operating system with the customer’s prior agreement.

Extended Warranty

Optionally, some of our products (e.g. PC systems) can be purchased with an extended warranty which provides additional protection against unexpected product failure beyond the standard period of two years. This warranty must be purchased at the same time as the product being protected and cannot be purchased retrospectively. In relation to PC Systems, two non-transferable extended warranty packages are offered.

The first warranty package is called the “Gold Warranty” and offers an additional warranty period of one year (i.e. three years total) in relation to labour and carriage only. Included in the warranty package is the cost of pickup and redelivery of the repaired PC for UK customers, or for international customers, the cost of redelivery of the repaired PC only. Also covered by the warranty is the cost of any labour charges associated with diagnosing, repairing or replacing any failed PC components which form part of the covered PC during the three year warranty period. However, the cost of repairing or replacing any component parts which have failed during the third year of ownership and which aren’t covered by the component manufacturer’s warranty, is not covered and must be paid for by the customer.

Our most comprehensive warranty package is called the “Platinum Warranty” and is similar to the Gold Warranty as described above except that the cost of repairing or replacing any component parts which have failed during the third year of ownership is fully covered, regardless of whether the component manufacturer’s warranty is in effect or not. Essentially, the whole PC is covered for parts, labour, pickup and redelivery for a period of three years from date of purchase. However, for customers located outside the UK, the carriage cost of returning a failed PC for repair must be paid for by the customer.

PC Upgrades

We offer an upgrade service for customers who have previously purchased a full PC system from us and who would like to upgrade it by adding additional or replacement parts to it. The cost of the upgrade is charged at £30+VAT per component replaced or added and this covers the labour cost of installation and testing. We don’t offer any rebate or trade-in value for any component that isn’t needed any more and any such components will be disposed of unless the customer requests for them to be returned along with the upgraded PC.

New components are charged at normal price as if they had been bought as separate components from our website. We offer free collection of the old PC within the UK but the cost of transporting the PC to us from international addresses must be paid for by the customer. For all customers, we charge for redelivery of the upgraded PC as though it were a newly purchased PC. The warranty of the original PC isn’t extended by the upgrade, but any newly added components are guaranteed for the length of the component manufacturer’s warranty. Any cost of fitting failed upgraded components after the PC warranty has expired is chargeable at the component upgrade cost as described above.

If a motherboard or system drive upgrade is requested then a clean version of Windows will need to be re-installed. Providing that the PC was originally ordered with Windows and the original licence key sticker is still affixed to the PC chassis then the cost of doing this is included in the £30 upgrade charge. The job of then restoring any files, settings and other software is the customer’s responsibility. If Windows needs to be re-installed but the licence key sticker is no longer affixed to the PC then a new Windows licence will need to be purchased, or the customer will need to reinstall the operating system. If a system drive is being upgraded to a larger capacity drive then the contents of the old system drive can optionally be copied to the new one so that all files, settings and programs are retained. The cost of doing this if required will be another £30+VAT.

It is the customer’s responsibility to back up all files, settings and software before returning the PC to us in case data is lost during the upgrade. We recommend using an external HDD for storing the backup which the customer should keep and not send to us with the PC in case the PC is lost or damaged in transit. If we re-install Windows then the backup will certainly be needed to restore the files, settings and software. A guide as to how to perform a backup can be found at this page.

Product Suitability

The customer is responsible for ensuring correct product selection and suitability for their own application and no responsibility or liability can be borne by Quiet PC Ltd for damage or loss incurred, including data loss, due to incorrect product selection or installation howsoever caused, either directly or consequentially. Installation of the products is at your own risk. For your own safety and to avoid damage to your computer we strongly recommend you read the installation instructions available on this website or supplied with the product, and if you have any doubt about your own ability to install the products then you should ask a qualified computer engineer to do the work for you.

Privacy Policy

Quiet PC Ltd is committed to protecting the privacy of our users. We will only use the information that we collect about you in accordance with current data protection legislation.

1. How do we use your personal data?

We use your personal data to:- process your order; send occasional promotional emails and information about our products or services to you, provided your consent has been freely given; allow you to create a customer account and view your order history.

2. What type of information do we collect?

The information we collect enables us to process your order and fulfil our contractual obligations to you. Such information may include, for example, your first and last name, billing and delivery address, telephone number and email address. We use your Internet Protocol (IP) address to help us to administer the site, analyse trends and assist in payment security checks. Our website may collect additional information about how you explore our website through “cookies”.

What are cookies?
Cookies are simple text files containing letters and numbers which are downloaded onto your device whenever you visit our site. When you revisit our site, the cookie allows our website to recognise you and tailors the information on screen to enhance your experience as a visitor to our website. We use the following types of cookie:

Session Cookies. This type of cookie serves a temporary purpose, facilitating basic functionality as you explore the website. Session cookies enable you to move swiftly from one place to the next and help to keep a record of the pages you visit. For example, these cookies remember the products you have put into your shopping basket.

Performance and Analytic Cookies. We use Google Analytics to gather statistics on website activity. The cookies help us to recognise, for example, whether you have visited our website on a previous occasion. This information is anonymous, it does not contain personal data such as your name or email address. You may be able to configure your cookie preferences through your browser settings to restrict cookies if you prefer. However, if you do choose to disable cookies you may find this affects the ability to use certain parts of the website; it may even prevent you from placing an order with us.

Social Media. Our website offers various ways to “Keep in Touch”, for example, via Facebook, Twitter and YouTube. Please be aware that these networks can record your actions and collect information about your Internet activity. We would strongly recommend that you read the respective privacy policies of these sites to understand how they intend to use your personal data. We do not accept responsibility for such links or have control over them.

Third Party Websites. We may offer links to other websites which we feel are relevant to our customers. As we have no control over such websites and if you choose to explore these sites further, it is important that you consider the independent privacy policies of these sites.

3. How we share your information in other ways

We use several third parties to assist us in running our business. Such parties are authorised to use your personal data only in relation to fulfilling our contractual requirements and legitimate business interests. For instance, we share personal data with shipping companies and payment service providers such as Stripe and PayPal. From time to time it may become necessary to disclose information to a third party if we sell our business, to assist in the prevention of fraud or to comply with a legal requirement.

4. Managing Personal Information

Consent to receiving marketing emails. We will not email you in the future for marketing purposes unless you have given us your consent to do so. You will see the opportunity to “opt-in” or “opt-out” of receiving marketing emails when you create an account on our website. Should you wish to opt-out at a later date, then just log onto your account, go to My Account/Other Information/Edit and amend accordingly.

Correction to or updating of personal data. It is your responsibility to ensure your personal information is up to date and correct on your customer account. You may amend your personal information through the website by logging into your account. Alternatively, please contact us if you require assistance.

Data retention. We will retain your personal data only for as long as is necessary to fulfil our contract with you and to ensure the fulfilment and compliance with our legal obligations.

Accessing your personal data. As a data subject, individuals have a number of rights in relation to their personal data. You may wish to make a request to see the personal information that we hold about you. This is known as a Subject Access Request (SAR). If you wish to make an SAR, we will tell you: How we came into possession of your data, how we used it and specific details held in our system; to whom your data is or may be disclosed; for how long your personal data is stored (or how that period is decided); your rights to rectification or erasure of data, or to restrict or object to processing; your right to refer to the Information Commissioner if your data protection concerns are not resolved to your satisfaction.

We may need to ask for proof of identification before the request can be processed. We will normally respond to a request within a period of one month from the date it is received. However, if a subject access request is manifestly unfounded or excessive, Quiet PC Ltd is not obliged to comply with it. Alternatively, we can agree to respond but we will charge a fee based on the administrative cost of responding to the request. A subject access request is likely to be manifestly unfounded or excessive where it repeats a request to which we have responded previously. If an individual submits a request that is unfounded or excessive, we will notify him/her that this is the case and confirm whether or not we will respond to it.

Retention of Title

Notwithstanding delivery and passing of risk, property in and title to the goods shall remain with the seller (Quiet PC Ltd) until the seller has received payment of the full price of (a) all Goods the subject of the Contract and (b) all other goods supplied by the seller to the buyer under any contract whatsoever. Payment of the full price shall include, without limitation, the amount of any interest or other sum payable under the terms of this and all other contracts between the seller and the buyer.

Waste Electrical and Electronic Equipment (WEEE)

Quiet PC Ltd is fully compliant with the government’s Waste Electrical and Electronic Equipment directive (WEEE) which came into effect on 1 July 2007. This legislation aims to reduce the amount of obsolete I.T. equipment going into landfill by forcing suppliers to pay for its safe disposal. Therefore we are now members of a government-approved “distributor take-back scheme” which offers recycling services for obsolete products which are no longer required. The amount of WEEE which consumers throw away is increasing by around 5% each year, making it the fastest growing waste stream in the UK. Much of the country’s WEEE ends up in landfill, where the lead and other toxins it contains can cause soil and water contamination. This can have a harmful effect on natural habitat, wildlife and also human health. Many electrical items that we throw away can be repaired or recycled. Recycling items helps to save our natural finite resources and also reduces the environmental and health risks associated with sending electrical goods to landfill.

Householders should be aware of the “crossed out wheeled bin symbol” which is printed on products or packaging as shown below. All new electrical and electronic equipment is marked with this symbol in order to encourage customers to recycle old unwanted electrical and electronic goods rather than disposing of them along with general household waste, thereby reducing the impact on the environment.
